Is AI Content Legal? A 2026 Legal Guide for AI Creators

Is it legal to create and sell AI-generated content?

Yes, in most of the world it's completely legal. In the US, the EU and most other markets, no law prohibits creating and selling AI-generated images, videos or text. The EU AI Act (2024/1689) regulates AI systems, but content creation does not fall into the prohibited or high-risk categories. This article is general information, not legal advice — always check the rules where you live.

Copyright questions

The copyright status of AI-generated content is still evolving in 2026. The current consensus:

  • Prompt = creative contribution — writing a prompt is a creative decision, which gives you some protection
  • Post-production strengthens your claim — face swapping, retouching and compositing all strengthen your copyright position
  • Platform ToS — Fanvue explicitly allows AI content; OnlyFans is stricter
  • Using someone else's face is FORBIDDEN — only use your own face or a fully generated one

Taxes

Fanvue revenue is taxable income, wherever you live. What that typically means:

  • Register as self-employed — in most countries, a sole proprietorship (or your local equivalent) is the usual setup for this kind of income. Many tax systems offer simplified or flat-rate regimes and deductions for small businesses — which one suits you depends on your country.
  • VAT / sales tax — many countries have a revenue threshold below which you don't need to charge VAT. Check the exact threshold where you live, and whether staying under it actually makes sense for you, with an accountant.
  • Foreign-currency income — Fanvue tracks your earnings in USD, with a $20 minimum payout by bank transfer. If you file taxes in another currency, the income usually has to be converted at an official exchange rate — ask your accountant which one applies. Practical guide: Fanvue payouts and withdrawals
  • Important: don't launch without an accountant — a single consultation costs little compared with fixing mistakes later

GDPR and data protection

If you create and sell AI content:

  • Your subscribers' data is handled by Fanvue (they are the data controller)
  • If you build an email list (like AI OFM does) and reach EU residents, GDPR consent is required
  • If you run your own website, a cookie banner and a privacy policy are mandatory

Fanvue's AI policy

According to Fanvue's 2026 policy:

  • ✅ AI-generated content is allowed
  • ✅ Using an AI persona/character is permitted
  • ❌ Using another real person's face without permission is FORBIDDEN
  • ❌ Content depicting minors in any form is FORBIDDEN

Summary

AI content creation is legal, taxable and can be done ethically. The keys: don't use anyone else's face, pay your taxes, and follow the platform's rules. On the AI OFM platform you get every tool you need to create content ethically and effectively.
